Trademark word behind magnifying glass

In a recent trademark dispute, bedding company Cathay Home Inc. has abandoned its federal application for the mark “Swift Home” following opposition from Taylor Swift’s company, TAS Rights Management LLC. The opposition, filed with the U.S. Patent and Trademark Office (USPTO), argued that the cursive “Swift” in Cathay’s proposed logo closely resembled the singer’s trademarked signature and could mislead consumers into believing she endorsed the brand’s products.

According to Cathay’s attorney, the company had not yet used the disputed mark in commerce and ultimately decided not to pursue registration, stating the mark was not essential to its business. Swift’s filing emphasized that she owns federal trademarks covering her name for use on bed linens, clothing, and other merchandise, and that the similarity between the marks created a likelihood of consumer confusion. Cathay reportedly did not respond to the substantive arguments before electing to abandon the application.

The case highlights the power of celebrity trademark portfolios and the importance of conducting thorough clearance searches before filing. With Taylor Swift’s brand extending well beyond music—including merchandise and lifestyle goods—businesses entering overlapping markets must carefully evaluate potential conflicts to avoid costly disputes or forced rebranding.
