New Jersey law firm CSG has filed a high-profile trademark infringement lawsuit against LIV golf team Hyflyers GC, an entity financed by the sovereign wealth of Saudi Arabia and led by Phil Mickelson. Cool Brands Supply has been using the same federal trademark logo for their skateboarding brand Fallen Footwear for 20 years. Cool Brands describes the “knockoff” mark as “reckless and inexplicable” as well as “willful infringement and unfair competition.” The similarities between the two marks are “striking” and damage the brand’s reputation by causing consumer confusion, according to the complaint. Cool Brands is seeking injunction against future use of the logo, destruction of all items bearing the mark as well as compensatory damages and legal fees. The 2023 LIV Golf Invitational is August 11-13 at the Trump National Golf Course in Bedminster.
